The CBD Controversy in American Medicine

Misconceptions have clouded American’s judgment many times in our history.  It happens when there is a hint of fear or there are hidden agenda’s to keep true knowledge secret.  There are many fears to face when practicing medicine and many agenda’s to fight through to get the best health treatment.  One medicine stands out most that have been pushed back by business competition and a misconception that needs to be made clear.  That medicine is CBD oil and the misconception is that it contains the mind-altering chemical THC making it unsafe and illegal to use.

What is CBD oil and why is it controversial in medicine today?

CBD oil comes from the Cannabis sativa plant.  CBD or cannabidiol is a chemical compound extracted from the hemp parts of the plant.  Manufactures grow a strain of Cannabis sativa plant that is high in CBDs and very low in THC (less than 0.3%.  THC comes from the same type of plant but a different strain that is bred to have higher amounts of THC.  THC is the chemical that gives you that “high” and is also an illegal mind-altering substance in some states.  We will get more into that soon.

Because the hemp plant bread for hemp products and CBD oil may contain less than 0.3% THC, this makes the CBD oil controversial involving legal medicine.  Marijuana that people smoke contains around 10-30% THC concentration.  Less than 0.3% will unlikely give you any feeling of that “high”.

As the popularity and support for CBD and medical marijuana grows, the less legal issues patients will run into.  THC also has medical benefits.  The Cannabis sativa plant is really a miracle plant and does not deserve the bad rep it has been given here in America.

UPDATE:  Due to this confusion between Cannabis plant species, most states that offer medical marijuana cards and are illegal recreationally have made it clear that ALL CBD oil is now illegal unless you have a medical marijuana card and obtain your CBD oil from a dispensary.  CBD oil with less than the 0.3% THC is NOW defined under marijuana laws.  States are claiming the Cannabis genus instead of the species now fall under marijuana drug laws.  However, the CBD oil conspiracy will be going to the supreme court and all of us are currently waiting for the supreme court ruling.  

There are 4 states left that CBD oil with larger amounts of THC is illegal.  Their laws are also still very unclear on the whole hemp discussion.  These states include Kansas, Idaho, Nebraska, and South Dakota.

There are 8 states where all things marijuana including CBD oil of all types are completely legal for recreational and medicinal use.  You don’t need a prescription for any product coming from hemp from these states:  Alaska, California, Colorado, Maine, Massachusetts, Nevada, Oregon, and Washington.

29 states fully legalize the use of CBDs and medical marijuana use with a prescription include:  Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Montana, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Dakota, Ohio, Oregon, Pennsylvania, Rhode Island, Vermont, Washington and West Virginia

This leaves 17 states that have specific CBD concentration usage for specific conditions and other state-specific laws: Alabama, Florida, Georgia, Indiana, Iowa, Kentucky, Mississippi, Missouri, North Carolina, Oklahoma, South Carolina, Tennessee, Texas, Utah, Virginia, Wisconsin, and Wyoming.

This state separation can make knowing if you are doing the right thing with your natural health path a bit cumbersome.  There is hope in the next 5 years that all states will be at the least be legal for medical marijuana and CBD use.  It all depends of course but the more time we have to release studies proving the benefits compared to pharmaceutical drugs, the more support for the legalization in all states.  The problem lies within the agendas of who we elect and the lobbyists.
